AI Labeling Obligation: What the EU Requires from August 2026
From August 2026, there will be a new regulation in the European Union stating that all content generated by artificial intelligence (AI) must be clearly labeled. This regulation is part of a broader approach to ensure transparency in the use of AI technologies and better educate consumers and users about the origin of content.
The EU aims to reduce the misuse of AI-generated content and ensure that users can clearly identify whether they are confronted with human or machine-generated information. The introduction of this labelling requirement is part of a larger regulatory framework that began with the proposal for the AI Regulation in April 2021. This Regulation aims to ensure a high level of protection of the rights and freedoms of natural persons while not unnecessarily restricting innovation in the AI sector.
In addition to the labelling requirement, the regulation also contains provisions for the risk categorisation of AI systems. High-risk systems, such as those used in critical infrastructures or that are concerned with the health and safety of people, are subject to stricter requirements.
Implementation of these new regulations will be a challenge for many companies. They need to adjust their processes to ensure that all AI-generated content is labeled correctly. This could also require technical adjustments, especially in areas such as content management systems and social media.
