GDPR outside the EU: When does the EU Data Protection Regulation apply?

15. October 2026 Laura DSGVO Datenschutz EU-Verordnung

The GDPR (General Data Protection Regulation) is an EU-wide regulation that regulates the protection of personal data. However, it does not only apply to companies in the European Union. Companies outside the EU may also be affected by the GDPR if they meet certain criteria. The regulation applies when a company has a branch in the EU or processes data of EU citizens. In addition, the GDPR is relevant for companies that process EU citizens’ data, whether they are based in the EU or not. Another criterion is if a company has a market location in the EU, i.e. is actively active there or serves customers from the EU. In these cases, the GDPR is applicable to the company even though it is not based in the EU. The regulation lays down clear obligations on how data may be collected, stored and deleted. It protects the rights of data subjects and obliges companies to communicate transparently and obtain the consent of users. Companies that process EU citizens’ data must therefore become familiar with the requirements of the GDPR in order to act in a legally compliant manner. Taking the DSG into account at any time and anywhere is crucial to avoid penalties and prosecutions. The GDPR is a central part of the data protection framework and ensures that the rights of users are respected, regardless of the geographical location of the company.
